By commissioning me (Artist) for custom artwork, you (Client) are agreeing to the Terms of Service outlined below:
I reserve the right to refuse or discontinue my services at any time for any reason.
I reserve the right to cancel and refund the order at any time for any reason.
I retain the copyright over commissioned works.*
I will NOT claim the intellectual property (IP) of the commissioned artwork. Your characters are still yours.
Any characters portrayed in the commissioned work by third parties remain copyrighted to their rightful owners.
I reserve the right to post the commissioned piece on my social media, publications, and portfolio.*
The terms outlined here may vary slightly depending on the type of commission (see Section 3).*
Read through this ToS with care.
Write in a clear and concise manner when sending out the commission request.
Maintain professional conduct throughout the commission process.
Respond in a timely fashion.
Provide pre-existing images of the subject and or any inspirational images that can be used as reference.
Assume responsibility for any important information and clear descriptions/references not provided to me that results in my inability to complete the commission to full satisfaction.

HOW TO REQUEST A COMMISSIONE-mail me at [email protected] or message me on TikTok @ciowio.art for any questions.All commissions will be completed on Ko-Fi. Please submit an inquiry there as follows:Subject: “COMMISSION TYPE/ Your Name & Social Media Handle (if available)”
Body of the message:

List what subject size (full body, half body, portrait/bust), type of background (simple or complex), number of characters, props, file size/specifications, and orientation of canvas (vertical or landscape) you want.Include a detailed description of the scene you have in mind and any information about the characters being portrayed. Please include in-depth photo and written references. Mood boards are welcome. Please refrain from using AI generated images as your only reference.List a second means of contact down here (e-mail address or TikTok user).
Request: Once I receive Client’s commission request, we will negotiate the piece price. The final price is subject to change based on demand and complexity of the requested piece. Deadlines must be agreed upon prior to the start of the commission.
Payment: Once accepted, I will send a payment request via PayPal. Refer to Section 4 (Payment) for more details.
Commission Starts: Once payment is received, I will start working on the piece. There will be three work-in-progress (WIP) low resolution and watermarked images submitted for approval during each stage of creation. The Client has a right to THREE revisions maximum. If Client requests any extra revisions past the initial three, they will refer to Section 6 (Revision Policy). Commissions can take me anywhere from 2 weeks to 3 months to complete depending on complexity of the piece and Client queue. Please let me know if there is a specific deadline in advance. I will inform Client of any delays if/when they occur.
Commission Completed: Upon piece completion, I will send Client a high resolution file and a web-friendly file size (PNG, JPG, TIF) for delivery via e-mail/ Google Drive. Images are always sent as 300 DPI PNGs by default unless another resolution/file type is requested. Note there is no physical product. If Client would like access to the Procreate work file, please let me know ahead of time.
Client retains the rights to the intellectual property (IP) of characters portrayed in the commissioned artwork. Client also has the right to request a commissioned piece to be private upon completion and or released/posted online on a later agreed upon date, regardless of commission type.Client must credit and have any online posts link back to me/tag my user when sharing or using the commissioned work.

PERSONAL COMMISSIONSA Client interested in a personal commission must include PERSONAL COMMISSION on the subject of their inquiry via e-mail/message.
Client will not distribute, sell, profit on, or claim the personally commissioned piece as their own. Client will refer to the section below (COMMERCIAL COMMISSIONS) if they desire to purchase rights and ownership of the commissioned piece.The Client may use or edit the personally commissioned work in the following ways:
Print the work for PERSONAL use.
Crop and/or resize the image for use as an avatar, header, video thumbnail, etc.
Use the artwork as reference for a study.
Post the artwork on social media, websites, and or forums with credit to me clearly visible.
Client may NOT use or edit the personally commissioned work in the following ways:
Claim the artwork as yours.
Remove my watermarks and or signature.
Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.
Use the commissioned piece in or with any technology related to NFTs, cryptocurrency, and AI.
Reproduce the work commercially (reselling, redistributing, uploading to POD-services, making prints for selling, etc.) without purchasing the rights from me.
COMMERCIAL COMMISSIONSA Client interested in a commercial use commission must include COMMERCIAL COMMISSION on the subject of their commission inquiry via e-mail or message.By default, commercial use of my work has a 5% royalty fee based on the revenue generated off of said piece. Any further terms/fees can be negotiated depending on Client use and type of project.If Client desires to purchase rights to the commissioned piece, a copyright fee equal to 300% of the agreed upon price will be paid by Client. Credit to me as the Artist is still required whilst using the commission commercially.
Payment MUST be in USD and via PayPal.Commissions can be paid either 100% upfront or split in half (50% upfront and 50% after Stage 1 approval).DO NOT send me any payment until it is mutually agreed to give Client a commission slot. I will request you to send me payment.If Client cannot fulfill their payment or fails to do so, refer to Section 5 (Cancellation & Refunds).FEES
A rush fee equal to 25% of the agreed upon price will be charged for tight deadlines.
A design fee equal to 50% of the agreed upon price will be charged for Client(s) with no reference images that would like me to draw solely from a description and/or a collection of photos.

If Client desires extra revisions, see Section 6 (Revision Policy).
I reserve the right to cancel and refund the money for Client’s commission at any time.DELAYS TO PAYMENT
If Client anticipates any delays in payment, Client will notify me of when they are able to pay the final balance as soon as possible. I have a right to pause work on the commission until the final balance is paid by Client.REFUND POLICYIf Client decides to cancel the commission PRIOR to my starting work on said piece, client will receive a 100% refund.If Client desires a refund, DO NOT request a PayPal chargeback. I will transfer the money back to Client myself.If Client decides to cancel the commission AFTER Stage 2, Client will receive NO refund. Client will get their final artwork delivered as notated above in Section 2 (Commissions Overview).KILL FEEIf Client decides to cancel the commission and said piece is IN Stages 1 or 2, Client will have a kill fee equal to 50% of the agreed upon price deducted from their total refund.PAYMENT VIOLATIONIf Client elects to split their payment and refuses/encounters continuous delays to pay the second half, I will discontinue the commission and said Client will be blacklisted from receiving my services.Client may NOT file a chargeback against me after granting final approval of the artwork.If Client requests a PayPal chargeback at any point when barred from asking for a refund, Client will lose ALL beforementioned rights to the commissioned piece. I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with the commission inquiry and subsequent conversations as evidence that I have completed work for Client. Furthermore, Client will be blacklisted for commissioning me again.
The client has a right to THREE revisions maximum. Opportunities to revise the commission will occur in between each stage. Revisions due to my own negligence are free.If Client requests any extra revisions past the initial three, they will be charged with a fee equal to 25% of the agreed upon price per change. Major changes (e.g., composition, poses or perspective) will incur a fee equal to 50% of the agreed upon price.If Client makes excessive minor revisions requests to the point that overall progress on the work is halted, I reserve the right to cancel the commission at no further cost to the Client.
